Additionally, I, on behalf of myself and my child (if applicable), agree to indemnify, defend and hold harmless Hadassah from any and all claims, liability, demands, damages, costs, losses, suits and expenses (including attorney’s fees) arising from, related to, or in connection with the event.
By registering for or attending this event, I, on behalf of myself and my child (if applicable), agree to comply with any and all COVID-19 related guidelines, as applicable to the event, which guidelines shall be established by Hadassah in its sole discretion. I further agree and certify that neither I nor my child (if applicable) will attend the event if I or my child (if applicable) have (i) any symptoms of COVID-19, (ii) tested positive or been diagnosed with COVID-19 prior to the event without quarantining and/or isolating for the period of time then recommended by the CDC, or (iii) been exposed to anyone diagnosed with COVID-19 prior to the event without quarantining and/or isolating for the period of time then recommended by the CDC. Further, I, on behalf of myself and my child (if applicable), understand that COVID-19 has been declared a pandemic and that a communicable infectious disease such as COVID-19 is highly contagious. I, on behalf of myself and my child (if applicable), also understand that attending an event sponsored by Hadassah, The Women’s Zionist Organization of America, Inc., its chapters, regions, affiliates and related entities will result in my or my child (if applicable) interacting with other people, including but not limited to, those attending the event, event and venue staff, and other individuals at the location at which the event may take place. For this reason, there is no way to guarantee, despite the best efforts of the individuals holding the event, that the other people attending the event have received COVID-19 vaccinations and/or booster shots, do not have, or have not been exposed to, COVID-19.
I hereby irrevocably grant to Hadassah the right to stream, post, photograph, film, and/or otherwise record, by any and all methods now or hereafter known, my and/or my child’s (if applicable) image, voice and/or likeness and to license, distribute, disseminate, display and/or otherwise use my and/or my child’s (if applicable) name and/or any stream, post, photograph, image, audio and/or visual recording, or likeness in which I or my child (if applicable) may appear or any utterance or statements I or my child (if applicable) may make in the course of my or my child’s (if applicable) participation in the event, including any photographs, images, audio and/or visual recordings I or my child (if applicable) may provide to Hadassah or its designees, or any portion thereof, in any media throughout the world, including, but not limited to, all digital media such as websites, emails, virtual meeting platforms, and social media, any number of times, in any and all manners, and by any and all means now or hereafter known, for any advertising, trade, fundraising, promotional or for any other purpose, without my or my child’s (if applicable) approval or any compensation unless required by law. I certify that I own or have the proper rights to license, distribute, disseminate, display and/or otherwise use any statements, photographs, images, audio and/or visual recordings that I or my child (if applicable) may provide to Hadassah or its designees for the purposes described in the preceding sentence. I agree that any stream, post, photograph, image, audio and/or visual recording, likeness, utterance or statement made during the course of the event shall be owned by Hadassah and shall be Hadassah’s sole and exclusive property, and Hadassah shall have the right to edit any such materials in Hadassah’s sole discretion. I hereby release Hadassah from any and all liability in connection with the use of my or my child’s (if applicable) name and/or any such stream, post, photograph, image, audio and/or visual recording, likeness, utterance or statement. I agree to execute, upon request by Hadassah, any and all additional documents necessary to effectuate the intent of the above-mentioned rights.
This Event Participant Release and Covid Waiver shall be interpreted as broadly as possible in favor of Hadassah, and shall be governed by and enforceable in accordance with and shall be subject to the laws of the State of New York without regard to its conflict or choice of law provisions. I hereby consent, on behalf of myself and my child (if applicable), to the exclusive personal jurisdiction and venue of any state or federal court located within the City of New York and waive any objection to jurisdiction and venue of any action instituted hereunder and agree not to assert any defense based on lack of jurisdiction or venue.
