Hadassah Hails Federal Court Ruling Finding So-Called ‘Partial-Birth Abortion Ban’ Unconstitutional

(New York, NY -- August 26, 2004) -- Hadassah applauds today’s ruling by U.S. District Judge Richard Casey (Southern District, New York) that finds the so-called ‘Partial-Birth Abortion Ban,' signed by President Bush last year, unconstitutional on the grounds that it does not include an exception permitting the banned procedure when necessary to preserve a woman’s health. Today’s decision follows a June ruling by a U.S. District Judge in San Francisco, who barred the U.S. Department of Justice from enforcing the ban, arguing that it places an undue burden on a woman’s right to choose.

In a statement today, Hadassah National President June Walker said: “As major health care providers in Israel and as health advocates in the U.S., Hadassah is pleased that Judge Casey has recognized that any law restricting abortion must contain an exception to protect a woman’s health.

“We see this decision as another important victory in the ongoing struggle to protect reproductive rights. The courts - including the U.S. Supreme Court in 2001 - have consistently struck down similar bans because they do not take into account risks to the woman’s health.”

Since 1981, Hadassah has staunchly advocated for reproductive rights. Hadassah regards reproductive freedom as an intrinsic right protected by the First Amendment, which guarantees freedom of religion and the separation of church and state.
