Hadassah Signs Amicus Briefs in Two Reproductive Rights Cases

Over the next month, the Supreme Court will hear two monumental cases on choice which have the potential to threaten the reproductive freedom of women across the nation. Hadassah believes women deserve agency over their own bodies and the autonomy to make reproductive health decisions based on medical guidance and their own values. Keep reading to learn more about what is at stake and what Hadassah is doing.

FDA v. Alliance

On March 26, the Supreme Court will hear oral arguments in the case of the Food and Drug Administration vs. Alliance for Hippocratic Medicine (FDA vs. Alliance). The case challenges the FDA’s approval of and expanded access to mifepristone, a medication that induces abortion, treats ectopic pregnancies, miscarriages and other medical conditions. If the Supreme Court decides in favor of Alliance, then access to mifepristone (the most common abortion regimen in the US) would end in all states, even in places where access to abortion is protected by state law.

US vs. Idaho

On April 24, the Supreme Court will hear oral arguments for US vs. Idaho. The Supreme Court will have to decide if Idaho’s abortion ban, with extremely narrow carveouts, is in violation of federal law. As written, the ban prevents doctors from providing abortions even in medical emergencies –– in direct conflict with the federal Emergency Medical Treatment and Active Labor Act. It is now in the hands of the Supreme Court if doctors in Idaho can continue to provide abortion health care in the direst of situations, or if they will be criminally punished.

What Hadassah is Doing

Hadassah is deeply disturbed to see access to necessary reproductive health care being threatened in a post-Dobbs environment, which is why we signed onto an interfaith amicus brief for FDA vs. Alliance. We also signed onto an amicus brief for US vs. Idaho which highlights the negative health impacts of abortion bans, especially for disadvantaged and minority women. Hadassah’s government relations director, Elizabeth Cullen, is also attending the oral arguments for FDA vs. Alliance at the Supreme Court in Washington, DC.
